REPRESENTATION OF THE PEOPLE

The European Parliamentary Elections (Welsh Forms) (Amendment) Order 1999

  Coming into force 31st May 1999 

The Secretary of State, in exercise of the powers conferred on him by sections 26 and 27(4) of the Welsh Language Act 1993[1], hereby makes the following Order:

     1.  - (1) This Order may be cited as the European Parliamentary Elections (Welsh Forms) (Amendment) Order 1999 and shall come into force on 31st May 1999.

    (2) In this Order "the 1989 Order" means the European Parliamentary Elections (Welsh Forms) Order 1989[
2].

     2. Article 3 of the Elections (Welsh Forms) Order 1995[3] and form 4 in Schedule 2 to the 1989 Order are hereby revoked.

     3.  - (1) The following forms of words, namely "Etholiad Senedd Ewrop", "RHANBARTH ETHOLIADOL CYMRU" and "Mae gennych un bleidlais" are hereby specified as the forms of words in Welsh for the words "Election for the European Parliament", "ELECTORAL REGION OF WALES" and "You have one vote", respectively, which are specified in the form of the front of the ballot paper in the Annex to Schedule 1 to the European Parliamentary Elections Regulations 1999[4] for use at European Parliamentary elections.

    (2) The following form of words, namely, "Marciwch X mewn un blwch" is hereby specified as the form of words in Welsh for the words "Mark X in one box" which are specified in the form of the front of the ballot paper referred to in paragraph (1) above for use at European Parliamentary elections.

    (3) The following form of words, namely,

    " Rhif

    Etholiad rhanbarth etholiadol Cymru ar 19.."

is hereby prescribed as the form of words in Welsh for the words

    " No.

    Election for the electoral region of Wales on ..... 19.."

which are specified in the form of the back of the ballot paper in the Appendix to Schedule 1 to the Representation of the People Act 1983[5] as it is applied for the purposes of European Parliamentary elections by regulation 3 of, and Schedule 1 to, the European Parliamentary Elections Regulations 1999.

    (4) The form of words in Welsh prescribed by-

    (a) paragraph (1) above shall be printed so that they appear to the right or left of, and

    (b) paragraphs (2) and (3) above shall be printed so that they appear immediately beneath or above,

the corresponding words in English on every ballot paper at a European Parliamentary election in Wales.

     4. In article 3 of the 1989 Order for the definition of the 1986 Regulations substitute:

     5.  - (1) In articles 4 and 5 of the 1989 Order, for any reference to regulation 5 of, and Schedule 1 or 2 to, the 1986 Regulations substitute a reference to regulation 3 of, and Schedule 1 or 2 to, the 1999 Regulations, respectively.

    (2) In article 5(d) omit "4" and "the form of nomination paper,".

    
6.  - (1) Schedule 1 to the 1989 Order is amended as follows.

    (2) For the English version of the first sentence of form 1 substitute "Put only one cross on the ballot paper." and for the Welsh version of that sentence substitute "Rhowch un groes yn unig ar y papur pleidleisio.".

    (3) In form 2-

    (4) In form 3, in the front of the card for "Etholaeth … Constituency" substitute "Rhanbarth Etholiadol Cymru Electoral Region of Wales".

    (5) In the back of form 4-

     7.  - (1) Schedule 2 to the 1989 Order is amended as follows.

    (2) In the second question in form 3 for "yr etholaeth hon" substitute "y rhanbarth etholiadol hwn".

    (3) In form 5-

    (4) In form 6 for "yr etholaeth hon" and "Etholaeth" substitute "y rhanbarth etholiadol hwn" and "Rhanbarth etholiadol", respectively.

EXPLANATORY NOTE

(This note is not part of the Order)


Articles 4 to 7 of this Order amend the European Parliamentary Elections (Welsh Forms) Order 1989 ("the 1989 Order") to take account of the replacement of the European Parliamentary Elections Regulations 1986 (S.I. 1986/2209) by the European Parliamentary Elections Regulations 1999 and the changes made by the latter Regulations. Those Regulations give effect to the regional list system of election for European Parliamentary elections introduced by the European Parliamentary Elections Act 1999 (c. 1).

Schedule 1 to the 1989 Order (which is amended by article 6 of this Order) sets out forms in English and Welsh to replace in Wales the forms which would otherwise be used. Schedule 2 to the 1989 Order (which is amended by article 7 of this Order) sets out the Welsh version of certain forms of words.

Article 3 of this Order prescribes a version in English and Welsh of words (other than the names of the parties or candidates standing for election) which appear on the ballot paper at a European Parliamentary election in Wales.
