BROADCASTING

The Limit in Relation to Licences to Provide Radio Multiplex Services Order 1999

  Made 29th March 1999 
  Coming into force 30th March 1999 

Whereas a draft of this Order has been laid before, and approved by resolution of each House of Parliament pursuant to paragraph 4 of Part I of Schedule 2 to the Broadcasting Act 1990[1].

     Now, therefore, the Secretary of State, in exercise of the powers conferred on him by paragraph 11(5) of Part III of Schedule 2 to the Broadcasting Act 1990[2], hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Limit in Relation to Licences to Provide Radio Multiplex Services Order 1999 and shall come into force on the day after the day on which it is made.

Amendment to paragraph 11 of Part III of Schedule 2 to the Broadcasting Act 1990
    
2.  - (1) Paragraph 11 of Part III of Schedule 2 to the Broadcasting Act 1990 (limits in relation to licences to provide national radio services, radio multiplex services or digital sound programme services) shall be amended in accordance with paragraphs (2) and (3) below.

    (2) In sub-paragraph (4)(a) for "10 per cent." there is substituted "20 per cent." and for "more than one body corporate" there is substituted "more than four bodies corporate".

    (3) In sub-paragraph (4)(b) for "10 per cent." there is substituted "20 per cent." and for "three or more bodies corporate" there is substituted "six or more bodies corporate".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the limit in relation to licences to provide radio multiplex services detailed in paragraph 11(4) of Part III of Schedule 2 to the Broadcasting Act 1990 by substituting a different numerical limit for any numerical limit for the time being specified there and by substituting a different percentage for any percentage for the time being specified there.
