The Secretary of State for Health, in exercise of powers conferred by section 126(4) of the National Health Service Act 1977[1] and section 5(7) of the National Health Service and Community Care Act 1990[2] and of all other powers enabling him in that behalf, hereby makes the following Regulations: Citation, commencement and interpretation 1. - (1) These Regulations may be cited as the National Health Service Trusts (Membership and Procedure) Amendment Regulations 1999 and shall come into force on 24th March 1999. (2) In these Regulations, "the principal Regulations" means The National Health Service Trusts (Membership and Procedure) Regulations 1990[3]. Amendment of the principal Regulations 2. In paragraph (5) of regulation 11 of the principal Regulations (disqualification for appointment of chairmen and non-executive directors)[4], after the words "National Blood Authority" there are inserted the words ", the National Health Service Information Authority, the National Institute for Clinical Excellence". Frank Dobson One of Her Majesty's Principal Secretaries of State, Department of Health 23rd March 1999 (This note is not part of the Regulations) These Regulations amend the National Health Service Trusts (Membership and Procedure) Regulations 1990 ("the principal Regulations") which make provision in connection with the membership and procedure of NHS trusts established under Part I of the National Health Service and Community Care Act 1990. In particular, they amend paragraph 5 of regulation 11 of the principal Regulations so as to allow the chairman or a non-officer member of the National Health Service Information Authority and of the National Institute for Clinical Excellence to be a chairman or non-executive director of an NHS trust.
