The National Assembly for Wales (Combination of Polls) (Apportionment of Cost) Order 1999

  Made 22nd March 1999 
  Coming into force 8th April 1999 

The Secretary of State for Wales, in exercise of the powers conferred upon him by article 14(4) and (8) of the National Assembly for Wales (Representation of the People) Order 1999[1] hereby makes the following Order-

Citation and commencement
     1. This Order may be cited as the National Assembly for Wales (Combination of Polls) (Apportionment of Cost) Order 1999 and shall come into force on 8th April 1999.

Interpretation
    
2. In this Order-

    "ordinary Assembly election" means the holding of elections for the return of all members to the National Assembly for Wales,

    "ordinary local government election" means the holding of elections for the return of all members to a community council, a county council or a county borough council, and

Apportionment of cost
     3.  - (1) Where the polls at an ordinary Assembly election and an ordinary local government election are combined under article 14(1) of the National Assembly for Wales (Representation of the People Order) 1999 the cost of taking the combined polls (excluding any cost solely attributable to one election) and any cost attributable to their combination shall be apportioned among the elections in such proportions as are specified below.

    (2) Subject to sub-paragraphs (3) and (4), the specified proportions by which the cost referred to in paragraph (1) of this article is to be apportioned shall be fifty per cent as to the ordinary Assembly election and fifty per cent as to the ordinary local government election.

    (3) Where paragraph (1) applies in respect of the services referred to in paragraph 1(5) or the expenses referred to in paragraph 7(1) to (6) and (8) of the Schedule to the Charges Order, the specified proportions by which the cost referred to in paragraph (1) of this article attributable to such services or expenses is to be apportioned shall be sixty per cent as to the ordinary Assembly election and forty per cent as to the ordinary local government election.

    (4) Where paragraph (1) applies in respect of expenses referred to in paragraph 4, 5 or 18 of the Schedule to the Charges Order, the specified proportions by which the cost referred to in paragraph (1) of this article attributable to such expenses is to be apportioned shall be sixty six and two thirds per cent as to the ordinary Assembly election and thirty three and a third per cent as to the ordinary local government election.

Where the polls at an ordinary election to the National Assembly for Wales or at an ordinary local government election are combined, this Order sets out how the cost of taking the combined polls (excluding any cost solely attributable to one election) and any cost which is attributable to their combination is to be apportioned among the elections.
