ENVIRONMENTAL PROTECTION

The Environment Act 1995 (Commencement No. 14) Order 1999

  Made 15th March 1999 

The Secretary of State, in exercise of his powers under section 125(3) and (4) of the Environment Act 1995[1], hereby makes the following Order:

Citation
     1. This Order may be cited as the Environment Act 1995 (Commencement No. 14) Order 1999.

Provisions coming into force on 16th March 1999
    
2. Subsection (1) of section 120 (minor and consequential amendments, transitional and transitory provisions, savings and repeals) of the Environment Act 1995 shall come into force on the day after that on which this Order is made, in so far as it relates to paragraph 162 of Schedule 22 to that Act, and to amendments made by that paragraph which confer power to make regulations.

Provisions coming into force on 1st April 1999
    
3. Subsection (1) of section 120 of the Environment Act 1995 shall come into force on 1st April 1999 in so far as it relates to paragraphs 67 and 69 to 72 of Schedule 22 (in so far as those provisions are not already in force).

EXPLANATORY NOTE

(This note is not part of the Order)


Article 2 of this Order commences on the day after the Order is made paragraph 162 of Schedule 22 to the Environment Act 1995 ("the 1995 Act"), to the extent that the provisions commenced by that paragraph (amendments of the Water Resources Act 1991 (c. 57) relating to anti-pollution works and operations) confer power to make regulations.

Article 3 of the Order commences substantively on 1st April 1999 paragraphs 67 and 69 to 72 of Schedule 22 to the 1995 Act which amend and supplement Part II (waste management licensing) of the Environmental Protection Act 1990 (c. 43). The provisions commenced relate to-

    (a) the making of representations in consultation processes before the grant, variation, suspension or revocation of waste management licences requiring the licence holder to carry out works which would necessitate the grant of rights over land; and

    (b) the payment of compensation for those required to grant rights over land to holders of those licences.

They are associated with the Waste Management Licences (Consultation and Compensation) Regulations 1999 (S.I. 1999/481).
