ROAD TRAFFIC

The Road Vehicles (Statutory Off-Road Notification) (Amendment) Regulations 1999

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by sections 22(1D), (1E) and (2), 57(1), (2) and (3) and 59(2)(a) of the Vehicle Excise and Registration Act 1994[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:-

Citation and commencement
     1. These Regulations may be cited as the Road Vehicles (Statutory Off-Road Notification) (Amendment) Regulations 1999 and shall come into force on 1st April 1999.

Amendment of the Road Vehicles (Statutory Off-Road Notification) Regulations 1997
    
2.  - (1) The Road Vehicles (Statutory Off-Road Notification) Regulations 1997[2] shall be amended as follows.

    (2) In regulation 5(1) for the word "Where" there shall be substituted "When".

    (3) For the heading of regulation 6 there shall be substituted-

    " Expiry of vehicle licence or nil licence".

    (4) In regulation 6(1)-

    (a) after the words "a vehicle licence" there shall be inserted "or a nil licence"; and

    (b) for the words "a further vehicle licence (or if appropriate a nil licence)" there shall be substituted "a vehicle licence or nil licence".

    (5) After regulation 7 there shall be inserted the following regulation-

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Road Vehicles (Statutory Off-Road Notification) Regulations 1997. Regulation 5 of those Regulations is amended so as to make it clear that, on the surrender of a vehicle licence, the required declaration must be made and particulars furnished at the same time as the licence is surrendered. Regulation 6 is amended so that the requirement to make a declaration and furnish particulars where a vehicle licence expires applies also on the expiry of a nil licence. By the insertion of a new regulation 8, prescribing the 1997 Regulations for the purposes of section 59(2)(a) of the Vehicle Excise and Registration Act 1994, offences of contravening or failing to comply with those Regulations will attract a fine not exceeding level 3 on the standard scale.
