The Public Lending Right Scheme 1982 (Commencement of Variations) Order 1999

  Laid before Parliament 23rd February 1999 
  Coming into force 1st July 1999 

Whereas the Public Lending Right Scheme 1982[1] ("the Scheme") was brought into force on 14th June 1982;

     and whereas the Scheme has previously been varied[2];

     and whereas the Secretary of State, after consultation with the representatives of authors and library authorities and with others who appear likely to be affected, has further varied the Scheme;

     now, therefore, the Secretary of State, in exercise of the powers conferred by section 3(7) of the Public Lending Right Act 1979[3] and now vested in him[4], hereby makes the following Order-

     1. This Order may be cited as The Public Lending Right Scheme 1982 (Commencement of Variations) Order 1999.

    
2. The variations in the Public Lending Right Scheme 1982 which were made on 22nd February 1999 and are set out in the Appendix to this Order shall come into force on 1st July 1999.

APPENDIX

VARIATIONS IN THE PUBLIC LENDING RIGHT SCHEME 1982 MADE BY THE SECRETARY OF STATE ON 22ND FEBRUARY 1999


     1. Article 6 of the Public Lending Right Scheme 1982 ("the Scheme") shall be varied by substituting the following for sub-paragraph (2)(g)-

      " (g) a book which does not have an International Standard Book Number."

     2. Article 42(3) of the Scheme shall be varied by substituting the following for sub-paragraph (c)-

      " (c) the Registrar may disregard any loan of a book reported from a sampling point in accordance with Article 40 where the local library authority does not specify an International Standard Book Number in respect of the book."



EXPLANATORY NOTE

(This note is not part of the Order)


This Order brings into force variations to the Public Lending Right Scheme 1982 made by the Secretary of State on 22nd February 1999.

The variations are set out in the Appendix. The effect of the variations is to allow the Registrar to disregard any loans of books that do not have an International Standard Book Number (ISBN).
