The Secretary of State, in exercise of the powers conferred on him by section 12A(1) of and paragraphs 1 and 3(1)(b) of Schedule 7A to the National Health Service (Scotland) Act 1978[1], and of all other powers enabling him in that behalf, hereby makes the following Order: Citation, commencement and interpretation 1. - (1) This Order may be cited as the Highland Communities National Health Service Trust (Establishment) Amendment Order 1999 and shall come into force on 17th February 1999. (2) In this Order "the principal Order" means the Highland Communities National Health Service Trust (Establishment) Order 1993[2]. Amendment of Article 3 of the principal Order 2. For article 3 of the principal Order there shall be substituted the following:-
(2) The Trust's functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the Trust for one or more Health Boards) shall be:-
(b) to acquire and dispose of land, buildings and other property whether referred to in the Schedule or not, which appears to the Trust to be necessary or expedient for the purpose of, or in connection with the carrying out of its functions referred to in paragraph (2)(a) of this article.".
(This note is not part of the Order) This Order substitutes a new article 3 in the Highland Communities National Health Service Trust (Establishment) Order 1993 to empower the trust to provide new facilities relating to learning disability and psychiatric services.
