REPRESENTATION OF THE PEOPLE

The Scottish Parliament (Regional Returning Officers) (Scotland) Order 1999

  Made 4th February 1999 
  Coming into force 8th February 1999 

The Secretary of State, in exercise of the powers conferred on him by section 12(6) of the Scotland Act 1998[1], and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation
     1.  - (1) This Order may be cited as the Scottish Parliament (Regional Returning Officers) (Scotland) Order 1999 and shall come into force on 8th February 1999.

    (2) In this Order-

    "local government area" means the area of a local authority.

Regional returning officers
     2. For the purposes of the Scotland Act 1998, the person designated as the regional returning officer for a region specified in the first column of the Schedule to this Order[3] shall be the person who, under section 41 of the Representation of the People Act 1983[4], is the returning officer at elections of councillors for the local authority for the local government area specified in the corresponding entry in the second column of that Schedule.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order designates persons to be the regional returning officers for each region in relation to the Scottish Parliament. The regional returning officer for each region will perform functions, conferred by or under the Scotland Act 1998 in relation to the election and return of regional members of the Scottish Parliament.

[3] The regions specified in the first column of the Schedule to this Order are the regions for the purposes of the Scotland Act 1998. Paragraph 2(2) of Schedule 1 to that Act provides that (subject to any Order in Council under the Parliamentary Constituencies Act 1986 (c.56) as that Act is extended by that Schedule) those regions shall be the eight European Parliamentary Constituencies provided for by the European Parliamentary Constituencies (Scotland) Order 1996 (S.I. 1996/1926).back
