BROADCASTING

The Broadcasting (Restrictions on the Holding of Licences) (Amendment) Order 1999

  Made 21st January 1999 
  Coming into force 22nd January 1999 

Whereas a draft of this Order has been laid before, and approved by resolution of each House of Parliament pursuant to paragraph 4 of Part I of Schedule 2 to the Broadcasting Act 1990[1];

     Now, therefore, the Secretary of State, in exercise of the powers conferred on him by Part V of Schedule 2 to the Broadcasting Act 1990 and all other enabling powers, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Broadcasting (Restrictions on the Holding of Licences) (Amendment) Order 1999 and shall come into force on the day after the day on which it is made.

Amendment
    
2. Article 16 of the Broadcasting (Restrictions on the Holding of Licences) Order 1991[2], shall be amended as follows:-

    (1) for sub-paragraph (a) of paragraph (1) there shall be substituted:-

      " (a) in the case of the Commission, licences to provide a Channel 3 service and a Channel 5 licence; and";

    (2) paragraphs (3), (4), and (5) shall be omitted.

EXPLANATORY NOTE

(This note is not part of the Order)


This order amends the Broadcasting (Restrictions on the Holding of Licences) Order 1991 by substituting a new sub-paragraph (a) of article 16(1) and revoking article 16(3), (4) and (5) so as to omit the words "domestic satellite service" following the amendments to the Broadcasting Act 1990 which were made by the Satellite Television Regulations 1997 (S.I. 1997/1682) and to permit any of the persons mentioned in Part V of Schedule 2 to the Broadcasting Act 1990 to hold a licence to provide a local delivery service.
