The General Optical Council (Registration and Enrolment (Amendment) Rules) - Order of Council 1999

  Made 6th January 1999 

At the Council Chamber, Whitehall, the 6th day of January 1999

By the Lords of Her Majesty's Most Honourable Privy Council

Whereas in pursuance of section 10 of the Opticians Act 1989[1] the General Optical Council have made the Registration and Enrolment (Amendment) Rules 1998 as set out in the Schedule to this Order:

     And whereas by section 34 of the said Act such rules shall not come into force until approved by Order of the Privy Council:

     And whereas upon rule 3 of the said rules coming into force the revocation mentioned therein will render wholly spent the General Optical Council (Registration and Enrolment (Amendment) Rules) Order of Council 1998[2]:

     Now, therefore, Their Lordships, having taken the said rules into consideration, are hereby pleased to approve the same, and hereby revoke with effect from 1st April 1999 the General Optical Council (Registration and Enrolment (Amendment) Rules) Order of Council 1998.

This Order may be cited as the General Optical Council (Registration and Enrolment (Amendment) Rules) - Order of Council 1999.

SCHEDULE

GENERAL OPTICAL COUNCIL


The Registration and Enrolment (Amendment) Rules 1998

In pursuance of their powers under section 10 of the Opticians Act 1989, the General Optical Council hereby make the following rules: - 

     1. These rules may be cited as the Registration and Enrolment (Amendment) Rules 1998.

     2. In the Registration and Enrolment Rules 1976 (which in their original form are scheduled to the General Optical Council (Registration and Enrolment Rules) Order of Council 1977)[
3] the Appendix shall be amended by replacing the figures £60, £35, £22, on each occasion where they appear, by the figures £85, £50 and £31 respectively.

     3. The Registration and Enrolment (Amendment) Rules 1997[4] (which will be spent on the coming into force of these Rules) are hereby revoked.

     4. These Rules shall come into force on 1st April 1999 and shall apply to applications for registration, enrolment, retention, restoration and transfer to take effect on or after 1st April 1999 whether made before, on or after that date.

EXPLANATORY NOTE

(This note is not part of the Order)


The rules approved by this Order increase with effect from 1st April 1999 the fees payable to the General Optical Council by ophthalmic and dispensing opticians and bodies corporate carrying on business as opticians for registration, enrolment or retention in, restoration to and transfer within the register of opticians. The fees were last fixed with effect from 1st April 1998 and the order of increase is approximately 40 per cent.

This Order also revokes a previous Order of Council which becomes spent on the revocation of rules which are scheduled to it.
