The Comhairle nan Eilean Siar (Electoral Arrangements) Order 1998

  Made 21st December 1998 
  Coming into force 1st January 1999 

Whereas under section 17(1) of the Local Government (Scotland) Act 1973[1], as read with Schedule 5 to that Act[2], the Local Government Boundary Commission for Scotland on 15th October 1998 submitted to the Secretary of State a report on a review together with its proposals for the future electoral arrangements for the area of Comhairle nan Eilean Siar;

     Now, therefore, in exercise of the powers conferred on him by sections 17(2) and 233(3) of, and Schedule 5 to, the said Act and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order:

Citation, commencement and application
     1.  - (1) This Order may be cited as the Comhairle nan Eilean Siar (Electoral Arrangements) Order 1998 and shall come into force on 1st January 1999.

    (2) This Order shall apply only for the purposes of elections to be held after 30th April 1999.

Interpretation
    
2. In the Schedule to this Order-

    (a) a reference to-

      (i) an electoral ward is a reference to that electoral ward as constituted in this Order; and

      (ii) a road, footpath, railway line, river, burn or canal shall, where the context so admits, be construed as a reference to the centre line of the feature concerned; and

    (b) the following abbreviations are used:-

    "EW" for electoral ward;

    "NG Ref" for National Grid Reference as published on Ordnance Survey Maps.

Electoral arrangements
    
3. The area of Comhairle nan Eilean Siar shall be divided into 31 wards, having the names, contents and boundaries set forth in the Schedule to this Order.

Revocation
    
4. The Western Isles Islands Area (Electoral Arrangements) Order 1992[3] is hereby revoked.

ELECTORAL WARDS


Ward 1 Port of Ness
Commencing on the northern boundary of Comhairle nan Eilean Siar at a point in line with the mouth of the Swainbost River; then generally northeastward, eastward, southeastward and southwestward along the said council boundary to a point in line with the mouth of an unnamed river immediately south of Dun Othail; then westward in a straight line to the mouth of the said unnamed river at NG Ref NB 5412 5136; then northwestward in a straight line to the point where an unclassified road linking the A857 and B8015 roads crosses the Swainbost River at NG Ref NB 5170 6213; then northwestward along the said river and the continuation thereof to the point of commencement.

Note: EW 1 includes the islands of Sula Sgeir and Rona and all the islands along the northern coastal extent.

Commencing on the northern boundary of Comhairle nan Eilean Siar where it meets the western boundary of EW 1 at a point in line with the Swainbost River; then southeastward along the said EW boundary to the mouth of an unnamed river immediately to the south of Dun Othail, NG Ref NB 5412 5136; then southwestward in a straight line to a cairn northeast of Beinn Mheadhonach at NG Ref NB 4940 5039; then southwestward in a straight line to the summit point of the said hill; then southwestward in a straight line to the confluence of the Allt a Deas Muirneag and the Gress River at NG Ref NB 4509 4799; then northwestward in a straight line to the source of the Allt Fisgro at NG Ref NB 4036 5406; then generally northeastward and northwestward along the said river and the continuation thereof to the northern boundary of Comhairle nan Eilean Siar; then northeastward along the said council boundary to the point of commencement.
