The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977[1] and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of facilities formerly managed by the Royal Victoria Infirmary and Associated Hospitals National Health Service Trust[2], having consulted the Newcastle upon Tyne Hospitals National Health Service Trust[3] and the Special Trustees for Newcastle University Hospital in accordance with section 92(3) of that Act, hereby makes the following Order:
Citation, commencement and interpretation
1. - (1) This Order may be cited as the Special Trustees for Newcastle University Hospital (Transfer of Trust Property) Order 1998 and shall come into force on 29th December 1998.
(2) In this Order-

"the Special Trustees" means the Special Trustees for Newcastle University Hospital;

"the Trust" means the Newcastle upon Tyne Hospitals National Health Service Trust;
-
"the trust property" means the items specified in a schedule of trust property prepared by, agreed upon by and signed on behalf of the Special Trustees and the Trust on 5th October 1998.
Transfer of trust property
2.
On 29th December 1998 the trust property shall be transferred from the Special Trustees to the Trust.

This Order transfers to the Newcastle upon Tyne Hospitals National Health Service Trust on 29th December 1998 trust property held by the Special Trustees for Newcastle University Hospital. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, Financial and Audit Support Branch, Quarry House, Quarry Hill, Leeds LS2 7UE.
