LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Authorities (Goods and Services) (Public Bodies) (No. 5) Order 1998

  Coming into force 30th December 1998 

The Secretary of State for the Environment, Transport and the Regions and the Secretary of State for Wales, acting jointly in exercise of the powers conferred by section 1(5) of the Local Authorities (Goods and Services) Act 1970[1], hereby make the following Order:

Citation and commencement
     1. This Order may be cited as the Local Authorities (Goods and Services) (Public Bodies) (No.5) Order 1998 and shall come into force on 30th December 1998.

Designation of public bodies
    
2. Each of the bodies named in column (1) of the Schedule to this Order, being a person appearing to the Secretary of State for the Environment, Transport and the Regions and to the Secretary of State for Wales to be exercising functions of a public nature, shall be a public body for the purposes of the Local Authorities (Goods and Services) Act 1970 in its application to England and Wales.

Restrictions on agreements
    
3. Agreements which may be entered into by virtue of this Order by any of the bodies mentioned in article 2 above shall be restricted in each case to agreements with an authority named in column (2) of the Schedule to this Order in respect of each such body for the supply of goods or materials or the provision of administrative, professional or technical services by that authority to that body in connection with the purposes of regeneration or economic development of any part of that authority's area.

EXPLANATORY NOTE

(This note is not part of the Order)


Article 2 of this Order designates the bodies listed in column (1) of the Schedule to the Order as public bodies under section 1(5) of the Local Authorities (Goods and Services) Act 1970.

The effect of designation is to allow a local authority to provide goods and services to the designated bodies. By virtue of article 3, the agreements which a designated body may enter into are restricted to agreements with an authority named in respect of that body in column (2) of the Schedule for the supply of goods or materials or the provision of administrative, professional or technical services by that authority to that body in connection with the purposes of regeneration or economic development of any part of that authority's area.
