LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Act 1988 (Defined Activities) (Exemption) (Lichfield District Council) Order 1998

  Made 30th November 1998 
  Laid before Parliament 9th December 1998 
  Coming into force 30th December 1998 

The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988[1], and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Lichfield District Council) Order 1998 and shall come into force on 30th December 1998.

Exemption of sports and leisure facilities management and other catering
    
2. The management of sports and leisure facilities[2] and other catering[3] by the Council of the District of Lichfield shall not be treated as a defined activity so long as it is carried out-

    (a) at the Burntwood Leisure Centre; and

    (b) during the period beginning with 30th December 1998 and ending immediately before 1st April 2001.

Revocation of Order
     3. The Local Government Act 1988 (Defined Activities) (Exemption) (Lichfield District Council) Order 1997[4] is hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Order)


Under Part I (competition) of the Local Government Act 1988 work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.

This Order replaces and extends the exemption from the requirements of Part I relating to the management by Lichfield District Council of the sports and leisure facilities at the Burntwood Leisure Centre. Its effect is to extend the current exemption (for the management by the Council of those facilities at the Centre) from 31st March 1999 to 31st March 2001 and to exempt catering by the Council at the Centre from the date on which the Order comes into force to 31st March 2001.
