In exercise of the powers conferred on the Secretary of State by section 144(1) and (3) of the School Standards and Framework Act 1998[1], the Secretary of State for Education and Employment hereby makes the following Regulations: Citation, commencement and interpretation 1. - (1) These Regulations may be cited as the School Standards and Framework Act 1998 (Allowances for Governors and Individual Pupil Information) (Modification) Regulations 1998 and shall come into force on 15th December 1998. (2) In these Regulations-
Modification of the 1996 Act (This note is not part of the Regulations) Paragraph 139 of Schedule 30 to the School Standards and Framework Act 1998 amends section 519 of the Education Act 1996, which relates to the payment of allowances to, inter alia, governors of schools which do not have delegated budgets and of institutions of further education maintained by local education authorities. As from 20th November 1998, the amendments to that section are in force for the purposes of making schemes and regulations under that section and are in force for all other purposes as from 1st April 1999. The categories of school referred to in section 519, as so amended, will not exist until 1st September 1999 and so these Regulations modify that section, as amended, so that it includes reference to the governors of county, voluntary, maintained special, grant-maintained and grant-maintained special schools in the period up to 1st September 1999. Paragraph 153 of Schedule 30 to the Act substitutes a new section 537A in the Education Act 1996 as from 20th November 1998. Section 537A relates to the provision of information about individual pupils. That section as substituted applies in relation to schools maintained by local education authorities, special schools not so maintained and independent schools. These Regulations modify that section so that, until 1st September 1999, the reference to schools maintained by local education authorities includes grant-maintained schools.
