In exercise of the powers conferred on the Secretary of State by sections 551 and 569(4) and (5) of the Education Act 1996[1], the Secretary of State for Education and Employment hereby makes the following Regulations: 1. These Regulations may be cited as the Education (Schools and Further Education) (Amendment) Regulations 1998 and shall come into force on 10th December 1998. 2. Regulation 10 of the Education (Schools and Further Education) Regulations 1981[2], shall be amended by the following provisions of these Regulations. 3. In paragraph (2)[3], for the words, "In each academic year a school shall meet for not less than 380 sessions which shall constitute the school year", there shall be substituted the words, "At least 380 sessions shall be held at a school during any school year". 4. For paragraphs (6A) and (7) there shall be substituted the following paragraphs-
(b) apply only in relation to sessions on or after 1st May; and (c) not have effect in relation to more than two such sessions.
(8) Paragraph (7) applies to training related to the teaching of numeracy or literacy, or both, for pupils in the first or second key stage.
(This note is not part of the Regulations) These Regulations amend regulation 10 of the Education (Schools and Further Education) Regulations 1981 ("the 1981 Regulations"). Paragraph (2) is amended so that the reference is now to a school to which the 1981 Regulations apply meeting for at least 380 sessions in each school year, rather than in each academic year. This brings the 1981 Regulations into line with section 551 of the Education Act 1996 which refers to the duration of the school year rather than the academic year. These Regulations make special provision in respect of the training of teachers at schools situated in England. Where, in the 1998/99 school year, one or more school sessions are devoted on or after 1st May to the training of teachers in the teaching of literacy or numeracy for pupils in the first or second key stage, then a maximum of two of those sessions are to be treated for the purposes of the 1981 Regulations (in particular the requirement that the school meet for no fewer than 380 sessions) as being sessions on which the school has met.
