Whereas on 18th September 1998 the Secretary of State was notified of the vacancy in the seat of the representative in the European Parliament for the constituency of North East Scotland by that Parliament under Article 12(2) of the Act concerning the election of the representatives of the European Parliament by direct universal suffrage annexed to the decision of the Council of the European Communities dated 20th September 1976[1]; Now, therefore, in exercise of the powers conferred on him by paragraph 3(3) of Schedule 1 to the European Parliamentary Elections Act 1978[2], the Secretary of State hereby makes the following Order: 1. This Order may be cited as the European Parliamentary Elections (Day of By-election) (North East Scotland Constituency) Order 1998 and shall come into force on 21st October 1998. 2. The by-election to fill the vacancy in the European Parliamentary constituency of North East Scotland shall be held on 26th November 1998.
