The Education (Proportion of Selective Admissions) Regulations 1998

In exercise of the powers conferred upon the Secretary of State by section 100(3) and 102(4) of the School Standards and Framework Act 1998[1], the Secretary of State for Education and Employment hereby makes the following Regulations:

     1. These Regulations may be cited as the Education (Proportion of Selective Admissions) Regulations 1998 and shall come into force on 1st October 1998.

    
2.  - (1) This regulation has effect for calculating "the proportion of selective admissions", within the meaning of section 100(3) or (as the case may be) 102(4) of the School Standards and Framework Act 1998, in relation to the admission of pupils in any relevant age group to a maintained school in any school year.

    (2) For the purposes of that calculation, the total number of pupils in any such age group admitted to the school in a school year shall be taken to equal the number of pupils in that age group which it is or was intended to admit to the school in that school year.

EXPLANATORY NOTE

(This note is not part of the Regulations)


Sections 100 and 102 of the School Standards and Framework Act 1998 permit the admission arrangements for a maintained school to contain certain forms of provision for the selection of pupils. One of the requirements under section 100 is that the proportion of selective admissions must not increase above the level set by the admission arrangements that applied at the beginning of the 1997/98 school year. Section 102 requires that the proportion of pupils selected by reference to aptitude for certain subjects must not exeed 10%.

These Regulations relate to the calculation of the proportion of selective admissions for these purposes. They provide that the total number of pupils admitted to the school in a relevant age group in a particular school year (from which the proportion is calculated) is to be taken to equal the number it is or was intended to admit to the school in that age group in that year.
