PROTECTION OF WRECKS

The Protection of Wrecks (Designation No. 2) Order 1984 (Amendment) Order 1998

  Made 17th July 1998 
  Laid before Parliament 20th July 1998 
  Coming into force 10th August 1998 

The Secretary of State, being satisfied that the site identified in article 2 of this Order is the site of a vessel lying wrecked on or in the sea bed and that, on account of the historical and archaeological importance of the vessel the site ought to be protected from unauthorised interference, after consulting with the persons referred to in section 1(4) of the Protection of Wrecks Act 1973[1], in exercise of the powers conferred upon him by section 1(1), (2) and (4) and section 3(2) of The Protection of Wrecks Act 1973 and all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as The Protection of Wrecks (Designation No. 2) Order 1984 (Amendment) Order 1998 and shall come into force on 10th August 1998.

Amendment of the Protection of Wrecks (Designation No. 2) Order 1984
    
2. The Protection of Wrecks (Designation No. 2) Order 1984[2] (as amended)[3] shall be amended as follows:

    (1) in Article 2(1) for the words "Latitude 50°39'.67 North, Longitude 01°54'.79 West" there shall be substituted the words "Latitude 50°39'.65 North, Longitude 01°54'.79 West".

Revocation
     3. The Protection of Wrecks (Designation No. 2 Order 1984) (Amendment) Order 1988[4] is hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Protection of Wrecks (Designation No. 2) Order 1984 by redefining the centre of the restricted area designated by that Order in Poole Bay near Poole, Dorset.

The amendment is made in order to encompass the likely distribution of archaeological material which has recently been located and to afford the site better protection. No part of the restricted area lies above the high water mark of ordinary spring tides.
