The Food (Cheese) (Emergency Control) (Amendment No. 2) Order 1998

  Coming into force 11th July 1998 

The Secretary of State, in exercise of the powers conferred by sections 13(1) and 48(1)(c) and (2) of the Food Safety Act 1990[1] and of all other powers enabling him in that behalf, it appearing to him that the carrying out of any commercial operation with respect to the class or description of food specified in the Food (Cheese) (Emergency Control) Order 1998[2] involves or may involve imminent risk of injury to health, hereby makes the following Order: - 

Citation, interpretation and commencement
     1.  - (1) This Order may be cited as the Food (Cheese) (Emergency Control) (Amendment No. 2) Order 1998 and shall come into force on 11th July 1998.

    (2) In this Order "the principal Order" means the Food (Cheese) (Emergency Control) Order 1998.

Amendment of article 2 of the principal Order
    
2.  - (1) Article 2 of the principal Order shall be amended as provided in paragraph (2) below.

    (2) Article 2 of the principal Order shall become Article 2(1) and there shall be added after that paragraph the following paragraph - 

        " (2) The prohibition in paragraph (1) shall not apply to cheese which is manufactured on or after 11th July 1998.".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Food (Cheese) (Emergency Control) Order 1998 (as amended by the Food (Cheese) (Emergency Control) (Amendment) Order 1998) which prohibits the carrying out of commercial operations in respect of cheese produced by R. A. Duckett & Co. Ltd.

Article 2 of this Order amends Article 2 of the principal Order in order to allow the carrying out of commercial operations in respect of cheese originating from R. A. Duckett & Co. Ltd. and manufactured on or after 11th July 1998.
