TELEGRAPHS

The Wireless Telegraphy (Guernsey) Order 1998

  Made 24th June 1998 
  Coming into force 24th July 1998 

At the Court at Buckingham Palace, the 24th day of June 1998

Present,

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by subsection (3) of section 20 of the Wireless Telegraphy Act 1949[1] as that subsection has effect by virtue of section 9(2) of the Wireless Telegraphy Act 1998[2], and section 9(3) of the Wireless Telegraphy Act 1998, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows: - 

     1. This Order may be cited as the Wireless Telegraphy (Guernsey) Order 1998 and shall come into force on 24th July 1998.

    
2. Sections 1 to 8 and 10(1) of, and the Schedules to, the Wireless Telegraphy Act 1998 shall extend to the Bailiwick of Guernsey with the following adaptations and modifications - 

        " (5A) The Secretary of State shall pay to the Treasurer of the States of Guernsey such proportion of the sums received under subsection (5) as appears to the Secretary of State to be appropriate.";

    (c) in section 6 - 

      (i) in subsection (2)(a), for the words "the London, Edinburgh and Belfast Gazettes" substitute "a newspaper circulating in the Bailiwick of Guernsey"; and

      (ii) at the end, add - 

        " (5) Any statutory instrument containing regulations made under this Act shall not have effect in the Bailiwick of Guernsey unless it is registered in the Royal Court of Guernsey; and where any such statutory instrument is so registered, it shall have effect on the day following the day of such registration or on the day of coming into force specified in the instrument, whichever is the later.";

    (d) in Schedule 1 - 

      (i) omit paragraph 3; and

      (ii) in paragraph 4, after "Broadcasting Act 1990" insert "as extended to the Bailiwick of Guernsey by the Broadcasting Act 1990 (Guernsey) Order 1991"[4];

    (e) in Part I of Schedule 2 - 

      (i) omit the references to section 3A of the Wireless Telegraphy Act 1949 and section 74 of the Telecommunications Act 1984[5];

      (ii) after "section 3(2) to (5)" insert "as extended to the Bailiwick of Guernsey by the Wireless Telegraphy (Channel Islands) Order 1969"[6]; and

      (iii) after "paragraph 2(2)" insert "as extended to the Bailiwick of Guernsey by the Broadcasting Act 1990 (Guernsey) Order 1991"; and

    (f) omit Part II of Schedule 2.

This Order extends to the Bailiwick of Guernsey sections 1 to 8 and 10(1) of, and the Schedules to, the Wireless Telegraphy Act 1998, with the adaptations and modifications specified in the Order.
