SEEDS

The Seed Potatoes (Fees) Regulations 1998

The Minister of Agriculture, Fisheries and Food in relation to England and the Secretary of State in relation to Wales, in exercise of the powers conferred by section 16(1) and (1A)(e) of the Plant Varieties and Seeds Act 1964[1] and now vested in them[2], after consultation with representatives of such interests as appear to them to be concerned, hereby make the following Regulations:

Title and commencement
     1. These Regulations may be cited as the Seed Potatoes (Fees) Regulations 1998 and shall come into force on 15th June 1998.

Fees
    
2. There shall be paid to the Minister, in respect of the matters referred to in the first column of the Schedule to these Regulations, the fee set out opposite in the second column (new fee) of that Schedule.

    
3. If an application for the classification of a crop of seed potatoes is withdrawn before the arrival of an inspector for the purpose of inspecting the crop for the first time there shall be paid to the Minister a fee of £15.

Revocation of previous Regulations
    
4. The Seed Potatoes (Fees) Regulations 1990[3] and the Seed Potatoes (Fees) (Amendment) Regulations 1991[4] are hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations, which revoke and replace the Seed Potatoes (Fees) Regulations 1990 and the Seed Potatoes (Fees) (Amendment) Regulations 1991, prescribe the fees payable for official examinations of seed potatoes under the Seed Potatoes Regulations 1991, as amended.

The relative fees for the inspection of growing crops of different classes of seed potatoes have changed to reflect the different amounts of time needed for inspections. In addition a separate fee has been introduced for the inspection of tubers after they have been harvested.

The matters in respect of which the revised or new fees are prescribed are listed in the Schedule and the fees which were chargeable before these Regulations come into force are printed beside the revised fees.

The fee to be retained by the Minister of Agriculture, Fisheries and Food in respect of an application for the classification of a crop of seed potatoes which is withdrawn is replaced by a fee of £15 (regulation 4).
