The Secretary of State for the Environment, Transport and the Regions in exercise of the powers conferred by section 41(1), (2) and (5) of the Road Traffic Act 1988[1] and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations: - Citation and commencement 1. These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 3) Regulations 1998 and shall come into force on 1st June 1998. Preliminary 2. - (1) The Road Vehicles (Construction and Use) Regulations 1986[2] shall be further amended in accordance with the following provisions of these Regulations. (2) The Secretary of State is satisfied that -
(b) notwithstanding that the said provisions will then apply to those vehicles, no undue hardship or inconvenience will be caused thereby.
Amendment of regulation 3 (interpretation)
(3) After paragraph (3B) there shall be inserted the following paragraph -
(4) After paragraph (5) there shall be inserted the following paragraph -
(5) In paragraph (5A)(b) for "16 m" there shall be substituted "16.4 m".
(b) in relation to any other vehicle, as a reference to the rearmost king-pin or, as the case may be, the rearmost king-pin position."
Amendment of regulation 10C (interpretation of regulations 10A and 10B - warning devices for high level equipment)
Amendment of regulation 13 (turning circle - buses)
(b) for "12 m" there shall be substituted "12.5 m".
(3) After paragraph (2) there shall be inserted the following paragraph -
(4) In paragraph (3) for "12 m" there shall be substituted "12.5 m".
(b) for the words "paragraph (i)(a) to (m) in the definition of "overall width"" there shall be substituted "paragraphs (a) to (m) in the definition of "overall width" and in paragraph (i)(a) to (o) in the definition of "overall length"".
(3) After paragraph (4) there shall be inserted the following paragraphs -
(6) An articulated vehicle shall be taken to comply with paragraph (4) if the semi-trailer comprised in it is, by virtue of paragraph 7.6.1.2 of Annex 1 of Community Directive 97/27/EC, deemed to comply with paragraph 7.6.1 of that Annex."
Amendment of regulation 13B (turning circle - articulated vehicles incorporating a car transporter)
(b) for the words "paragraph (i)(a) to (m) in the definition of "overall width"" there shall be substituted "paragraphs (a) to (m) in the definition of "overall width" and in paragraph (i)(a) to (o) in the definition of "overall length"".
(3) After paragraph (4) there shall be inserted the following paragraphs -
(6) An articulated vehicle shall be taken to comply with paragraph (4) if the semi-trailer comprised in it is, by virtue of paragraph 7.6.1.2 of Annex 1 of Community Directive 97/27/EC, deemed to comply with paragraph 7.6.1 of that Annex."
Turning circle - heavy motor car
13C. - (1) This regulation applies to a vehicle which -
(b) was manufactured or, in the case of a vehicle combination, the part consisting of a heavy motor car, was manufactured after 31st May 1998; and (c) is not a vehicle falling within any of the descriptions specified in paragraph (2).
(2) The descriptions of vehicle referred to in paragraph (1)(c) are -
(b) a vehicle or a vehicle combination to which regulation 13, 13A or 13B applies; (c) a vehicle constructed and normally used for the carriage of indivisible loads of abnormal length.
(3) Every vehicle to which this regulation applies shall be able to move on either lock so that, both with and without all its wheels in contact with the surface of the road and disregarding the things set out in paragraphs (a) to (m) in the definition of "overall width" and in paragraph (i)(a) to (o) in the definition of "overall length" in the Table in regulation 3(2), no part of it projects outside the area contained between concentric circles with radii of 12.5 m and 5.3 m."
Amendment of regulation 35 (speedometers)
70B. - (1) This regulation applies to a vehicle which is not a goods vehicle fitted in accordance with regulation 70 with a Ministry plate containing the particulars required by Schedule 10A or 10C and which is either -
(b) a trailer used in combination with a vehicle falling within paragraph (a) and manufactured after 31st May 1998.
(2) A vehicle to which this regulation applies shall not be used unless -
(b) those particulars are included in the particulars shown on the plate with which the vehicle is equipped in accordance with regulation 66."
Amendment of Schedule 2 (Community directives)
(This note is not part of the Regulations) These Regulations further amend the Road Vehicles (Construction and Use) Regulations 1986 ("the 1986 Regulations"). Regulation 4 amends regulation 7 of the 1986 Regulations which relates to the maximum overall length of vehicles and vehicle combinations. Regulation 5 corrects an error in regulation 10C (which provides for the interpretation of regulations 10A and 10B - warning devices for high level equipment) of the 1986 Regulations and regulation 6 amends regulation 11 of those Regulations so as to modify the requirements as to the maximum permitted overhang in relation to heavy motor cars. Regulations 7 to 10 make provision as to turning circles of buses and articulated vehicles by amending regulations 13, 13A and 13B of the 1986 Regulations and inserting a new regulation 13C as to the turning circle of a heavy motor car or a heavy motor car drawing a trailer which is not a semi-trailer. Regulations 11 and 12 respectively amend regulations 35 (speedometers) and 49 (rear under-run protection) of the 1986 Regulations by substituting references to the most recent EC Directives and regulation 13 inserts a new regulation 70B requiring the fitting to certain vehicles of plates showing the dimensions. Regulation 14 makes consequential amendments to Schedule 2. Copies of the Directives can be obtained from the Stationery Office. A compliance cost assessment has been prepared and copies can be obtained from the Department of Transport, Zone 2/01, Great Minster House, 76 Marsham Street, London SW1P 4DR (telephone 0171-676 2065).
