CIVIL AVIATION

The Carriage by Air Acts (Application of Provisions) (Fourth Amendment) Order 1998

  Coming into force in accordance with Article 1.

The Queen's Most Excellent Majesty in Council

Whereas a draft of this Order has been laid before Parliament and has been approved by a resolution of each House of Parliament, in accordance with section 10(5) of the Carriage by Air Act 1961[1]:

     Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 10 of the Carriage by Air Act 1961, and of that section as applied by section 5(2) of the Carriage by Air (Supplementary Provisions) Act 1962[2], and of all other powers enabling Her in that behalf is pleased, by and with the advice of Her Privy Council to order, and it is hereby ordered, as follows: - 

     1. This Order may be cited as the Carriage by Air Acts (Application of Provisions) (Fourth Amendment) Order 1998 and shall come into force on the tenth day after the day on which it is made.

    
2. The Carriage by Air Acts (Application of Provisions) Order 1967[3] is hereby amended as follows:

    (1) In Article 4(a) after "Schedule 2" there shall be inserted "or Schedule 3".

    (2) After Article 5 there shall be inserted the following article - 

         " 5A.  - (1) Schedule 3 to this Order shall have effect in respect of carriage to which this Order applies, being carriage which is international carriage as defined in that Schedule.

        (2) Section 2 of the Act of 1961 shall apply to such carriage as aforesaid with the following modifications to subsection (1):

      (a) For "Convention" where it first appears there shall be substituted "Warsaw Convention as amended by Additional Protocol No. 1 of Montreal 1975[4]";

      (b) For "at the end of the Convention as set out in the First Schedule to this Act" there shall be substituted "to the Warsaw Convention".

        (3) Section 8 of the Act of 1961 shall apply to such carriage as aforesaid, with the following adaptations and modifications:

      (a) For "Convention" where it first appears there shall be inserted "Warsaw Convention as amended by Additional Protocol No. 1 of Montreal 1975";

      (b) The words "as set out in the First Schedule to this Act" shall be omitted;

      (c) The reference to "the said Schedule" shall be construed as a reference to the amended Convention as applied by Schedule 3 to this Order.".

    (3) In Part A of Schedule 2 - 

    (a) in paragraph 3(7), for the word "goods" there shall be substituted the word "cargo";

    (b) after paragraph 3(10) there shall be inserted the following sub-paragraph: - 

        " (10A) Article 15(3) shall not apply.";

    (c) after paragraph 3(14) there shall be inserted the following sub-paragraph: - 

        " (14A) Article 25A shall not apply.".

    (4) In Part B of Schedule 2 Articles 15(3) and 25A shall be omitted.

    (5) After Schedule 2 there shall be inserted the following Schedule -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Carriage by Air Acts (Application of Provisions) Order 1967, as amended (which applies the provisions of the Carriage by Air Act 1961 and the Carriage by Air (Supplementary Provisions) Act 1962, with modifications set out in the Order, to carriage to which those Acts would otherwise not apply). The principal amendments provide for the deletion of Articles 15(3) and 25(A) of the Warsaw Convention as amended at The Hague 1955 from their application to international carriage under the unamended Warsaw Convention and for the introduction of an additional Schedule (Schedule 3) to have effect in respect of certain international carriage to which Additional Protocol No. 1 of Montreal 1975 applies (which introduces a new unit of account - the Special Drawing Right - for the purposes of the Warsaw Convention as amended by Additional Protocol No. 1 of Montreal 1975). That Protocol came into force on 15th February 1996.
