Whereas the Secretary of State has, in pursuance of subsection (4) of section 306 of the Merchant Shipping Act 1995[1], consulted with the organisations referred to in that subsection; Now therefore, the Secretary of State, in exercise of the powers conferred by section 47 of the Merchant Shipping Act 1995 and of all other powers enabling him in that behalf, hereby makes the following Regulations. 1. These Regulations may be cited as the Fishing Vessels (Certification of Deck Officers and Engineer Officers) (Amendment) Regulations 1998 and shall come into force on 8th May 1998. 2. The Fishing Vessels (Certification of Deck Officers and Engineer Officers) Regulations 1984[2] shall be amended as follows. 3. In regulation 7, in both paragraphs (2) and (3) for "may be issued in accordance with these Regulations and such a certificate" there shall be substituted "issued before 8th May 1998". 4. In regulation 8 -
(b) in paragraph (3) for "certificate of competency, certificate of equivalent competency or a certificate of service" there shall be substituted "certificate of competency or a certificate of equivalent competency".

In regulation 9(1) for ", certificates of equivalent competency and certificates of service"there shall be substituted "and certificates of equivalent competency". (This note is not part of the Regulations) These Regulations further amend the Fishing Vessels (Certification of Deck Officers and Engineer Officers) Regulations 1984. They remove provisions enabling the issue of new certificates of service whilst preserving existing certificates of service. (Certificates of service were a transitional provision to allow experienced, but unqualified, fishermen to continue their employment, once the requirement for certificates of competency were introduced by those 1984 Regulations).
