SAFETY

The Fishing Vessels (Safety Provisions) (Amendment) Rules 1998

Whereas the Secretary of State is a Minister designated[1] for the purpose of section 2(2) of the European Communities Act 1972[2] in relation to measures relating to the safety of ships, and the health and safety of persons on them;

     And whereas, in so far as the following Rules are made in the exercise of powers conferred by section 121 of the Merchant Shipping Act 1995[3] the Secretary of State has in pursuance of subsection (4) of section 306 of that Act consulted organisations he considers will be affected as mentioned in that subsection:

     Now, therefore, the Secretary of State, in exercise of the powers conferred by the said section 2(2) of the European Communities Act 1972, and by sections 121 and 307 of the Merchant Shipping Act 1995 and of all other powers enabling him on that behalf, hereby makes the following Rules:

Citation and commencement
     1. These Rules may be cited as the Fishing Vessels (Safety Provisions) (Amendment) Rules 1998 and shall come into force on 1st May 1998.

Purpose
    
2. The purpose of these Rules is to provide for the implementation in part of Council Directive 93/103/EC of 23rd November 1993[4], on the introduction of minimum safety and health requirements for work on board fishing vessels.

Amendment of principal Rules
     3. The Fishing Vessels (Safety Provisions) Rules 1975[5], shall be further amended as follows.

     4. For Rule 1(2) there shall be substituted: - 

        " (2)

      (a) Subject to sub-paragraph (b) below, these Rules apply to every mechanically propelled sea-going vessel registered in the United Kingdom under Part II of the Register of Ships maintained in accordance with Part II of the Merchant Shipping Act 1995.

      (b) Where a heading of a Rule refers to additional requirements for certain fishing vessels, that Rule shall apply only to such fishing vessels of that length (except that a reference to vessels of 15 metres in length or over shall not apply to fishing vessels constructed before 23rd November 1995 of less than 18 metres in length) and shall come into force:

        (i) for fishing vessels with a length of 15 metres or over which were constructed on or after 23rd November 1995, on 1st May 1998;

        (ii) for fishing vessels with a length of 18 metres or over which were constructed before 23rd November 1995, insofar as the structural characteristics permit, on 23rd November 2002.

      (c) For the purposes of sub-paragraph (b) above:

        (i) a vessel for which a building or major conversion contract was placed before 23rd November 1995 and which is delivered before 23rd November 1998 shall be regarded as constructed before 23rd November 1995; and

        (ii) "length" means length between perpendiculars.".

EXPLANATORY NOTE

(This note is not part of the Rules)


These Rules give effect in part, in relation to sea-going United Kingdom fishing vessels, to the European Communities Council Directive 93/103/EC of 23rd November 1993 concerning the minimum safety and health requirements for work on board fishing vessels. They do so by further amending the Fishing Vessels (Safety Provisions) Rules 1975 ("SPR").

The amendments implement certain requirements in parts of Annexes I (new fishing vessels, i.e. constructed on or after 23rd November 1995), II (existing vessels) and III and IVof the Directive relating to the following matters - 

    (a) seaworthiness and stability (Annexes I and II, section 1) (rule 8, SPR new rule 16A);

    (b) mechanical and installations (Annexes I and II, section 2) (rules 10-13 and 17, SPR new rules 41A, 42A, 51(3), 54A(1) and (2) and 72(A));

    (c) emergency routes and exits (Annexes I and II, section 4) (rule 14, SPR new rule 60A);

    (d) fire detection and fire fighting (Annexes I and II, section 5) (rule 18, SPR new rule 106A);

    (e) decks, bulkheads and deckheads (Annexes I and II, section 9) (rule 15, SPR new rule 65A(1));

    (f) traffic routes - danger areas (Annexes I and II, section 11), (rule 15, SPR new rule 63A);

    (g) layout of workstations (Annexes I and II, section 12) (rules 9 and 13, SPR new rule 20A and 54B);

    (h) accommodation ladders and gangways (Annexes I and II, section 16) (rule 16, SPR new rule 65A(4));

    (i) musters and drills (Annex III, section 5) (rule 19, SPR new rule 119);

    (j) personal protective equipment (Annex IV) (rule 15, SPR new rule 65B);
