The Local Authorities (Direct Labour Organisations) (Competition) (Insolvency) (Amendment) (Wales) Regulations 1998

  Coming into force 20th August 1998 

The Secretary of State for Wales, in exercise of the powers conferred on him by sections 9(3) and 23(1) of the Local Government, Planning and Land Act 1980[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Local Authorities (Direct Labour Organisations) (Competition) (Insolvency) (Amendment) (Wales) Regulations 1998 and shall come into force on 20th August 1998.

Amendment of Local Authorities (Direct Labour Organisations) (Competition) (Wales) Regulations 1997
    
2.  - (1) The Local Authorities (Direct Labour Organisations) (Competition) (Wales) Regulations 1997[2] shall be amended in accordance with the following paragraphs of this regulation.

    (2) In regulation 9(1) (regulated functional work), for "regulations 10 and 10A" substitute "regulation 10, 10A and 10B".

    (3) After regulation 10A (exempted functional work - schools), insert -

EXPLANATORY NOTE

(This note is not part of the Regulations)


Regulation 2 of these Regulations amends the Local Authorities (Direct Labour Organisations) (Competition) (Wales) Regulations 1997 so that local authorities in Wales are exempt from the competitive tendering requirements of Part III of the Local Government, Planning and Land Act 1980 in respect of certain functional work. The functional work is that which consists of a job the whole or part of which the authority is undertaking because a contractor has been, but, by reason of falling within regulation 10B(3) as inserted by these Regulations, is no longer undertaking for that authority, and the authority will be undertaking the work for no more than 12 months from the day on which the contractor ceased to undertake the work in question.
