The Area Tourist Boards Amending Scheme (Scotland) Order 1998

  Made 26th February 1998 
  Coming into force 5th March 1998 

The Secretary of State, in exercise of the powers conferred on him by sections 172(4)(a) and 173 of the Local Government etc. (Scotland) Act 1994[1] and of all other powers enabling him in that behalf and after consulting in accordance with section 173(4)(a) of that Act the Scottish Tourist Board and each new local authority whose area lies wholly or partly within the area of each area tourist board whose scheme is being amended, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Area Tourist Boards Amending Scheme (Scotland) Order 1998 and shall come into force on 5th March 1998.

Amending scheme
    
2. The scheme set out in the Schedule to this Order shall have effect.

SCHEDULE
Article 2


AREA TOURIST BOARDS AMENDING SCHEME


     1.  - (1) The scheme set out in the Schedule to each Order listed in paragraph 3 below shall be amended in accordance with paragraph 2 below.

     2. In paragraph 8(2)-

    (a) at the end of sub-paragraph (b) delete "and"; and

    (b) after sub-paragraph (b) insert-

      " (ba) to borrow such sums as it may require;

      (bb) to grant security over its assets in respect of obligations incurred by it; and

      (bc) to grant guarantees for obligations (arising out of loans or otherwise) incurred by other persons or grant indemnities; and".

     3. The Orders[2] referred to in paragraph 1 above are-

EXPLANATORY NOTE

(This note is not part of the Order)


This Order makes an amending scheme which amends all the schemes establishing the area tourist boards in Scotland by inserting an express statement in each scheme that the area tourist board established by that scheme has a power to borrow, to grant security, to grant guarantees for third party obligations and to grant indemnities.
