URBAN DEVELOPMENT

The London Docklands Development Corporation (Transfer of Property, Rights and Liabilities) (Lee Valley Regional Park Authority) Order 1998

  Made 25th February 1998 
  Laid before Parliament 3rd March 1998 
  Coming into force 24th March 1998 

The Secretary of State for the Environment, Transport and the Regions in exercise of the powers conferred on him by section 165B of the Local Government, Planning and Land Act 1980[1], and of all other powers enabling him in that behalf, having consulted the council of the London borough of Newham (being the local authority in whose area the relevant urban development area is situated, hereby makes the following Order - 

Citation and commencement
     1.  - (1) This Order may be cited as the London Docklands Development Corporation (Transfer of Property, Rights and Liabilities) (Lee Valley Regional Park Authority) Order 1998.

    (2) This Order shall come into force on 24th March 1998.

Transfer of property, rights and liabilities
    
2.  - (1) In this article - 

    "the Corporation" means the London Docklands Development Corporation;

    "the Land" means the land which is shown bounded externally by a red line on the Maps; and

    "the Maps" means the maps respectively labelled "Map 1" and "Map 2" entitled "Maps referred to in the London Docklands Development Corporation (Transfer of Property, Rights and Liabilities) (Lee Valley Regional Park Authority) Order 1998", one set of which, signed by an Under Secretary in the Government Office for London, has been deposited and is available for inspection at the offices of each of the following - 

    (a) the Department of the Environment, Transport and the Regions;

    (b) the Lee Valley Regional Park Authority;

    (c) the council of the London borough of Newham; and

    (d) the council of the London borough of Tower Hamlets.

    (2) The Land, together with any rights and liabilities which the Corporation has in relation to the Land, is hereby transferred from the Corporation to the Lee Valley Regional Park Authority on the date of the coming into force of this Order[2].

Amendments to the Lee Valley Regional Park Act 1966
     3.  - (1) At the end of section 15 of the Lee Valley Regional Park Act 1966[3] (powers to acquire land) there shall be inserted the following subsection - 

        " (3) The Authority may acquire by means of an order made by the Secretary of State under section 165B of the Local Government, Planning and Land Act 1980, any land, whether within or without the park, together with any rights or liabilities relating to that land.".

    (2) After section 23 of that Act (land outside park acquired for purposes of park) there shall be inserted the following section -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order transfers from the London Docklands Development Corporation to the Lee Valley Regional Park Authority land known as Bow Creek Ecology Park and East India Dock Bird Sanctuary, together with the rights and liabilities of the Corporation relating to that land (article 2). The land is shown edged with a black line and hatched on the map below.

The Order amends the Lee Valley Regional Park Act 1966 for the purpose of enabling the Lee Valley Regional Park Authority to acquire the land (article 3(1)), and so that the land is deemed to be part of the Lee Valley Regional Park for the purposes of that Act (article 3(2)).

The maps referred to in the Order may be inspected during normal office hours at the following offices - 

    (a) the Department of the Environment, Transport and the Regions, 2 Marsham Street, London SW1P 3EB;

    (b) the Lee Valley Regional Park Authority, Myddelton House, Bulls Cross, Enfield, Middlesex EN2 9HG;

    (c) the council of the London borough of Newham, Town Hall, Barking Road, East Ham, London E6 2RP; and

    (d) the council of the London borough of Tower Hamlets, Town Hall, Mulberry Place, 5 Clove Crescent, London E14 2BG.

[2] There are no proposals to transfer the Land, or these rights or liabilities, under section 165 or 165A of the Local Government, Planning and Land Act 1980. Section 165 was amended by section 180 of, and Schedule 22 to, the Leasehold Reform, Housing and Urban Development Act 1993 (c.28) ("the 1993 Act") and by section 143(3) of the 1996 Act. Section 165A was inerted by section 180(2) of the 1993 Act and was amended by section 143(4) of the 1996 Act.back
