NORTHERN IRELAND

The Northern Ireland (Emergency Provisions) Act 1996 (Code of Practice) Order 1998

  Made 15th February 1998 
  Laid before Parliament 16th February 1998 
  Coming into force 11th March 1998 

Whereas - 

    (1) in pursuance of section 53(1)(a) of the Northern Ireland (Emergency Provisions) Act 1996[1] (hereinafter referred to as "the 1996 Act") the Secretary of State is required to make a code of practice in connection with the silent video recording of interviews held by police officers of persons detained under section 14(1)(a) or (b) of the Prevention of Terrorism (Temporary Provisions) Act 1989[2];

    (2) in pursuance of section 54(2) of the 1996 Act the Secretary of State has prepared and published a draft code of practice in connection with the said matter and has considered representations made to her about the draft and modified it accordingly;

    (3) in pursuance of section 54(3) of the 1996 Act the Secretary of State has laid a draft of the code of practice before both Houses of Parliament:

     Now, therefore, the Secretary of State, in exercise of the powers conferred upon her by section 54(3) of the 1996 Act, hereby orders as follows:

Citation and commencement
     1. This Order may be cited as the Northern Ireland (Emergency Provisions) Act 1996 (Code of Practice) Order 1998 and shall come into force on 11th March 1998.

Code of Practice
    
2. The code of practice laid in draft before Parliament on 4th February 1998 in connection with the silent video recording of interviews held by police officers of persons detained under section 14(1)(a) or (b) of the Prevention of Terrorism (Temporary Provisions) Act 1989 shall come into operation on 11th March 1998.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order appoints 11th March 1998 as the date on which the code of practice made under section 53(1)(a) of the Northern Ireland (Emergency Provisions) Act 1996 ("the 1996 Act") will come into operation.

By virtue of section 53(2) of the 1996 Act, the code applies in connection with the silent video recording of interviews held by police officers of persons detained under section 14(1)(a) or (b) of the Prevention of Terrorism (Temporary Provisions) Act 1989.

The code of practice will be published by The Stationery Office Limited; copies may be obtained from The Stationery Office Bookshops.
