The Secretary of State, in exercise of the powers conferred on him by sections 98, 105(7) and 108(1) of the National Health Service (Scotland) Act 1978[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations: Citation, commencement and interpretation 1. - (1) These Regulations may be cited as the National Health Service (Charges to Overseas Visitors) (Scotland) Amendment Regulations 1998 and shall come into force on 4th March 1998. (2) In these Regulations, a reference to "the principal Regulations" is a reference to the National Health Service (Charges to Overseas Visitors) (Scotland) Amendment Regulations 1989[2]. Amendment of Regulation 4 of the principal Regulations 2. - (1) Regulation 4 of the principal Regulations (overseas visitors exempt from charges) shall be amended by-
(b) inserting at the end of paragraph (p) the word "; or"; (c) inserting after paragraph (p) the following paragraph:-
Amendment of Schedule 2 to the principal Regulations (This note is not part of the Regulations) These Regulations further amend the National Health Service (Charges to Overseas Visitors) (Scotland) Regulations 1989 to provide that an overseas visitor pursuing a full time course of study is exempt from charges for NHS Services. The previous qualification that industrial or analogous experience formed an integral part of the course is removed. The Regulations also remove Hong Kong from the list of countries in respect of which the United Kingdom Government has entered into a reciprocal agreement.
