CONTRACTING OUT

The Contracting Out (Functions in relation to the Management of Crown Lands) Order 1998

  Made 9th February 1998 
  Coming into force 10th February 1998 

Whereas a draft of this Order has been laid before, and approved by a resolution of, each House of Parliament pursuant to section 77(2) of the Deregulation and Contracting Out Act 1994[1];

     Now therefore the Secretary of State, in exercise of the powers conferred on him by section 69 of that Act and of all other powers enabling him in that behalf, hereby makes the following Order: - 

Citation and Commencement
     1. This Order may be cited as the Contracting Out (Functions in relation to the Management of Crown Lands) Order 1998 and shall come into force on the day after the day on which it is made.

Contracting out of functions
    
2. The functions now vested in the Secretary of State under section 21 of the Crown Lands Act 1851[2] may be exercised by, or by employees of, such person (if any) as may be authorised in that behalf by the Secretary of State.

EXPLANATORY NOTE

(This note does not form part of the Order)


This Order enables the Secretary of State for Culture, Media and Sport to authorise another person (or that person's employees) to perform those management functions, in relation to certain properties owned by the Sovereign in right of the Crown, which are vested in him by section 21 of the Crown Lands Act 1851.

[2] 1851 c.42 (14 & 15 Vict.). The Crown Lands Act 1851 is extensively amended and the greater part of it is now repealed. Words are omitted from section 21 by the Schedule to the Statute Law Revision Act 1892 and, by reason of section 7(5) of the Parliamentary Corporate Bodies Act 1992, section 21 no longer has effect in relation to the Palace of Westminster. Functions vested in the Commissioners of Works by section 21 have been the subject of orders transferring functions namely: -  the Ministry of Works (Transfer of Powers) (No. 1) Order 1945 (S.R.&O. 1945/991), the Secretary of State for the Environment Order 1970 (S.I. 1970/1681) and the Transfer of Functions (National Heritage) Order 1992 (S.I. 1992/1311). The Minister of Works (Change of Style and Title) Order 1962 (S.I. 1962/1549) and the Secretary of State for Culture, Media and Sport Order 1997 (S.I. 1997/1744) changed the title of the office in which the functions are vested by section 21.back
