The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated[1] for the purposes of subsection (2) of section 2 of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, acting jointly in exercise of the powers conferred upon them by that subsection and of all other powers enabling them in that behalf, hereby make the following Regulations: Title and commencement 1. These Regulations may be cited as the Hill Livestock (Compensatory Allowances) (Amendment) Regulations 1998 and shall come into force on 16th February 1998. Amendments to the Hill Livestock (Compensatory Allowances) Regulations 1996 2. - (1) The Hill Livestock (Compensatory Allowances) Regulations 1996[3] shall be amended in accordance with the following paragraphs of this regulation. (2) In paragraph (1) of regulation 2 (interpretation) -
(b) the following definition shall be inserted immediately after the definition of "the 1994 Regulations" -
(3) In paragraph (3) of regulation 2 there shall be substituted for "the Hill Livestock (Compensatory Allowances) (Amendment) Regulations 1997" the following -
(4) In paragraph (1A) of regulation 3 (compensatory allowances for breeding cows and ewes) -
(b) in sub-paragraphs (a) and (b)(i), for "£97.50" there shall be substituted "£47.50"; (c) in sub-paragraph (b)(i), for "£121.49" there shall be substituted "£88.70"; and (d) in sub-paragraphs (b)(ii) and (c), for "£69.75" there shall be substituted "£23.75".
(5) In paragraph (1B) of regulation 3 -
(b) in sub-paragraph (b)(ii)(aa), for "£121.49" there shall be substituted "£88.70".
(6) In paragraph (2) of regulation 3, for ", the 1992 Regulations or the 1984 Regulations" there shall be substituted "or the 1992 Regulations".
(b) there shall be inserted after the phrase "the 1996 Order" the phrase "or the 1997 Regulations".
(10) In paragraph (4) of regulation 12 (withholding or recovery of compensatory allowance), for "article 5 of the 1995 Order" there shall be substituted "regulation 3(3) and (4) of the 1997 Regulations". (This note is not part of the Regulations) 1. These Regulations amend the Hill Livestock (Compensatory Allowances) Regulations 1996 (S.I. 1996/1500, as already amended by S.I. 1997/33). 2. Those Regulations of 1996 extend to Great Britain. 3. S.I. 1996/1500 complies with Council Regulation (EC) No. 950/97 on improving the efficiency of agricultural structures (OJ No. L142, 2.6.97, p.1). 4. These Regulations set revised rates of payment in respect of the 1998 Scheme year for the annual compensatory allowance for certain breeding cows and ewes payable under regulation 3 of S.I. 1996/1500. 5. These Regulations also make minor drafting changes to regulations 2(1) and (3), 3(2), 9(5)(a) and 12(4) of S.I. 1996/1500. 6.
