Whereas it appears to the Minister of Agriculture, Fisheries and Food that the import of pistachios originating in, or consigned from, Iran may involve imminent risk of injury to health, now therefore the said Minister, in exercise of the powers conferred on him by sections 6(4), 13(1) and 48(1) of the Food Safety Act 1990[1], and of all other powers enabling him in that behalf, hereby makes the following Order: Title and commencement 1. This Order may be cited as the Food (Pistachios from Iran) (Emergency Control) (Amendment) Order 1997 and shall come into force on 23rd December 1997. Amendment of previous Order 2. The Food (Pistachios from Iran) (Emergency Control) Order 1997[2] shall be amended by the insertion at the end of article 2(1) (prohibition of import) of the words "except in accordance with the conditions in Article 2 of Commission Decision 97/830/EC of 11th December 1997 repealing Commission Decision 97/613 and imposing special conditions on the import of pistachios and certain products derived from pistachios originating in, or consigned from, Iran[3]". Jeff Rooker Minister of State, Ministry of Agriculture, Fisheries and Food 22nd December 1997 (This note is not part of the Order) This Order, which is made by the Minister of Agriculture, Fisheries and Food under section 13 of the Food Safety Act 1990, amends the Food (Pistachios from Iran) (Emergency Control) Order 1997 by exempting from the prohibition on import of pistachios originating in, or consigned from, Iran importation in accordance with the conditions in Article 2 of Commission Decision 97/830/EC of 11th December 1997 repealing Commission Decision 97/613/EC and imposing special conditions on the import of pistachios and certain products derived from pistachios originating in or consigned from Iran (OJ No. L343, 13.12.97, p.30). Article 2 of Commission Decision 97/830/EC permits the import of Iranian pistachios only where accompanied by Iranian Government health certificates and results of sampling and analysis. Article 2 of the Decision also requires that the import of such pistachios takes place only through specified points of entry, that each consignment of such pistachios be identified with a code corresponding with that on the health certificate and sampling and analysis results and that such imports be subjected to sampling and analysis for Aflatoxin B1 and total Aflatoxin before release onto the market.
