The Secretary of State, in exercise of the powers conferred on him by section 34(1) and (4) of the Local Government and Rating Act 1997[1] and of all other powers enabling him in that behalf, hereby makes the following Order: Citation 1. This Order may be cited as the Local Government and Rating Act 1997 (Commencement No.3) Order 1997. Commencement of provisions 2. Subject to article 3 below, the following provisions of the Local Government and Rating Act 1997 shall come into force on 1st December 1997:-
(b) section 8 (orders under section 6 and Schedule 2); (c) section 33(1) (minor and consequential amendments), insofar as it relates to the provision mentioned in paragraph (d) below; and (d) paragraph 29(b) of Schedule 3 (amendment of Schedule 12 to the Local Government Finance Act 1992[2]).
Transitional provision (This note is not part of the Order) This Order brings into force on 1st December 1997 certain provisions of the Local Government and Rating Act 1997 which relate to Scotland only. The provisions in question are listed at article 2 and concern the new system of mandatory and discretionary relief from non-domestic rates for general stores and other premises in rural settlements set up by the Act. Article 3 provides that the Order does not have effect so as to apply the new system of relief for any financial year prior to 1998/99. (This note is not part of the Order) The following provisions of the Local Government and Rating Act 1997 have been brought into force by commencement order made before the date of this Order:
