The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by sections 7, 12 and 24 of the Superannuation Act 1972[1], section 9(4)(aa) of the Local Government, Planning and Land Act 1980[2], section 23 of the Local Government Finance Act 1982[3], sections 6(3), 8(1) and (2) and 15(6) and (7) of the Local Government Act 1988[4], and section 9 of the Local Government Act 1992[5] and of all other powers enabling them in that behalf, and after consultation (as required by section 35(3) of the Local Government Finance Act 1982) with the Audit Commission for Local Authorities in England and Wales, such associations of local authorities as appear to them to be concerned (as also required by section 7(5) of the Superannuation Act 1972) and such bodies of accountants as appear to them to be appropriate, hereby make the following Regulations - Citation, commencement and application 1. - (1) These Regulations may be cited as the Local Government Act 1988 (Competition) (Revocations) Regulations 1997 and shall come into force on 12th December 1997. (2) Subject to paragraph (3), these Regulations apply to work which is proposed to be carried out in England and Wales on or after the date on which these Regualtions come into force. (3) These Regulations do not apply to work in respect of which a notice has been published in accordance with subsection (1) of section 7 (the conditions) of the Local Government Act 1988 before that date. Revocation of Regulations and Savings 2. - (1) Subject to paragraph (2) the Regulations listed in column (1) of the Schedule to these Regulations are revoked to the extent indicated in column (3). (2) Nothing in paragraph (1) shall affect the application of the Local Government (Direct Services Organisations) (Competition) Regulations 1993[6] to defined authorities in Scotland. (This note is not part of the Regulations) These Regulations revoke the Regulations listed in column (1) of the Schedule to the extent mentioned in column (3), in so far as they apply to defined authorities in England and Wales. The effect of the revocations is to remove restrictions imposed for the purposes of Part I (competition) of the Local Government Act 1988 on the specification of contract periods for manual services, on the timing of tendering requirements and on the treatment of extraneous costs for the purposes of the evaluation of bids and tenders. The Regulations also revoke regulation 10 of, and the Schedule to, the Accounts and Audit Regulations 1996. The effect of the revocation is to relieve those authorities to whom the regulation applied of the need to publish a statement of support service costs. Notes: [1] 1972 c.11.back [2] 1980 c.65.
