LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Act 1988 (Defined Activities) (Exemptions) (Amendment) Order 1997

  Laid before Parliament 21st November 1997 
  Coming into force 1st April 1998 

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by sections 2(9) and 15(5) of the Local Government Act 1988[1], and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement
     1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (Amendment) Order 1997 and shall come into force on 1st April 1998.

2. Paragraph (2) of article 3 of the Local Government Act 1988 (Defined Activities) (Exemptions) (England) Order 1988[2] is amended by the substitution for "£100,000" of "£150,000".

     3. Paragraph (2) of article 3 of the Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) Order 1988[3] is amended by the substitution for "£100,000" of "£150,000".

EXPLANATORY NOTE

(This note is not part of the Order)


The Local Government Act 1988 (Defined Activities) (Exemptions) (England) Order 1988 and the Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) Order 1988 ("the 1988 Orders") exempted a number of manual services carried out by local authorities in England and Wales in any financial year from the competition requirements of Part I of the Local Government Act 1988 so long as, in respect of each individual service, the cost to the authority of the service in the preceding financial year did not exceed £100,000. This Order raises that limit to £150,000.
