AGRICULTURE

The Food Industry Development Scheme (Specification of Activities) Order 1997

  Coming into force 1st December 1997 

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the power conferred upon them by sections 50(2)(c) and 62(1) of the Agriculture Act 1993[1], hereby make the following Order:

Title and commencement
     1. This Order may be cited as the Food Industry Development Scheme (Specification of Activities) Order 1997 and shall come into force on 1st December 1997.

Activities specified for the purposes of section 50(2) of the Agriculture Act 1993 in relation to the Food Industry Development Scheme
    
2.  - (1) The following activities are hereby specified for the purposes of section 50(2) of the Agriculture Act 1993 as activities covered by paragraph 4(1)(c) of the Food Industry Development Scheme 1997[2] - 

    (a) the shooting and harvesting in the wild of game;

    (b) the repeated harvesting above ground level at intervals of less than ten years of short rotation coppice; and

    (c) the catching of fish.

    (2) In paragraph (1) of this article - 

    (a) "game" has the same meaning as in section 1 of the Poaching Prevention Act 1862[3];

    (b) "short rotation coppice" means a perennial crop of tree species which has been planted at high density; and

    (c) "fish" includes shellfish as defined in section 50(9) of the Agriculture Act 1993.

Amendment of the Marketing Development Scheme (Specification of Activities) Order 1994[4]
     3. The Marketing Development Scheme (Specification of Activities) Order 1994 shall be amended as follows - 

In paragraph 2(1) after the words "section 50(2) of the Agriculture Act 1993" there shall be added the words "as activities covered by paragraph 2(b) of the Marketing Development Scheme 1994.[

EXPLANATORY NOTE

(This note is not part of the Order)


    
1. This Order specifies the following activities for the purposes of section 50(2)(c) of the Agriculture Act 1993 as activities in respect of which payments may be made under paragraph 4(1)(c) of the Food Industry Development Scheme 1997, namely - 

    (a) the shooting and harvesting in the wild of game;

    (b) the repeated harvesting above ground level at intervals of less than ten years of short rotation coppice; and

    (c) the catching of fish, including shellfish.

     2. "Game" and "short rotation coppice" are defined in article 2(2) of this Order.

    
3. The Marketing Development Scheme (Specification of Activities) Order 1994 is amended to apply only to payments made under paragraph 2(b) of the Marketing Development Scheme 1994.
