The Secretary of State, in exercise of powers conferred on him by section 41(3) and (4) of the National Health Service (Primary Care) Act 1997[1] and of all other powers enabling him in that behalf, hereby makes the following Order: - Citation 1. This Order may be cited as the National Health Service (Primary Care) Act 1997 (Commencement No. 2) Order 1997. Appointed day 2. The day appointed for the coming into force of section 36 of the National Health Service (Primary Care) Act 1997 (expenditure of Health Authorities) is 14th October 1997. Saving 3. Notwithstanding article 2, in relation to -
(b) amounts allotted to Health Authorities in respect of such a financial year,
section 97 of the National Health Service Act 1977[2] shall continue to have effect as if this Order had not been made. (This note is not part of the Order) This Order brings into force section 36 of the National Health Service (Primary Care) Act 1997. Section 36 amends section 97 of the National Health Service Act 1997, which relates to the funding of Health Authority expenditure. (This note is not part of the Order) The following provisions of the National Health Service (Primary Care) Act 1997 have been brought into force by commencement order made before the date of this Order:
