The Prescription as "Persons in Need" (Persons subject to Immigration Control) (Scotland) Order 1997

  Made 29th September 1997 
  Coming into force 30th September 1997 

The Secretary of State, in exercise of the powers conferred on him by section 94(1) of the Social Work (Scotland) Act 1968[1], and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Prescription as "Persons in Need" (Persons subject to Immigration Control) (Scotland) Order 1997 and shall come into force on 30th September 1997.

Interpretation
    
2. In this Order, unless the context otherwise requires-

    "the Act" means the Social Work (Scotland) Act 1968; and

Prescription of persons subject to immigration control as "persons in need" for the purposes of the Act
     3. Persons subject to immigration control within the meaning of section 13(2) of the 1996 Act are prescribed as "persons in need" for the purposes of the 1968 Act.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order prescribes as "persons in need" for the purposes of the Social Work (Scotland) 1968 persons subject to immigration control within the meaning of section 13(2) of the Asylum and Immigration Act 1996. This has the effect of making them eligible for assistance under section 12 of that Act provided they satisfy the criteria set out in that section.
