ROAD TRAFFIC

The Motor Cycle (EC Type Approval) (Amendment) Regulations 1997

  Coming into force 22nd October 1997 

The Secretary of State for Transport, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred by that section and of all other powers enabling him in that behalf, hereby makes the following Regulations: - 

Commencement, citation and extent
     1. These Regulations may be cited as the Motor Cycle (EC Type Approval) (Amendment) Regulations 1997 and shall come into force on 22nd October 1997.

Amendment to Schedule
    
2.  - (1) The Schedule to the Motor Cycle (EC Type Approval) Regulations 1995[3] shall be amended as follows.

    (2) The following item shall be inserted after item 10 - 

11 95/1dagger L52, 8.3.95, p.1 Maximum design speed, maximum torque and maximum net engine power"


    (3) For the note at the end of the Schedule there shall be substituted - 

    " Note: the Directive marked with a dagger is a Directive of the European Parliament and the Council. The other Directives are Council Directives."

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Schedule to the Motor Cycle (EC Type Approval) Regulations 1995 so as to add European Parliament and Council Directive 95/1/EC to the list of separate Directives which relate to the type approval of components.

Directive 95/1/EC relates to the methods of measuring the maximum design speed, maximum engine torque and net maximum engine power of two and three wheeled motor vehicles.

Copies of the Directive can be obtained from the Stationery Office.
