LOCAL GOVERNMENT, ENGLAND AND WALES

The Local Government Act 1988 (Defined Activities) (Exemption) (Brent London Borough Council and Harrogate Borough Council) Order 1997

  Made 16th September 1997 
  Laid before Parliament 25th September 1997 
  Coming into force 16th October 1997 

The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988[1], and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Brent London Borough Council and Harrogate Borough Council) Order 1997 and shall come into force on 16th October 1997.

Exemption of grounds maintenance
    
2. The maintenance of ground by the council of the London borough of Brent shall not be treated as a defined activity so long as it is carried out at the Chilcott Nursery, Birchen Grove, Kingsbury, London NW9 8RY before 1st October 1998.

Exemption of building cleaning and catering for purposes other than schools and welfare
    
3.  - (1) The activities mentioned in paragraph (2) shall not be treated as defined activities so long as they are undertaken by the council of the borough of Harrogate at the Island Site of the Harrogate International Centre (comprising the Conference Centre, Exhibition Halls, Royal Hall and Royal Baths Assembly Rooms) during the period beginning with 1st October 1997 and ending on 31st March 1999.

    (2) The activities are - 

    (a) cleaning of buildings; and

    (b) catering (other than catering for purposes of schools and welfare).

EXPLANATORY NOTE

(This note is not part of the Order)


Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.

Article 2 of this Order exempts from the requirements of Part I the maintenance of ground by the council of the London borough of Brent so long as it is carried out at the Chilcott Nursery, Birchen Grove, Kingsbury, London NW9 8RY before 1st October 1998.

Article 3 of this Order exempts building cleaning and catering (other than catering for purposes of schools and welfare) from the requirements of Part I so long as they are carried out by the council of the borough of Harrogate at the Island Site of the Harrogate International Centre (comprising the Conference Centre, Exhibition Halls, Royal Hall and Royal Baths Assembly Rooms) during the period beginning with 1st October 1997 and ending on 31st March 1999.
