IMMIGRATION

The Immigration (Exemption from Control) (Amendment) (No. 2) Order 1997

  Coming into force in accordance with Article

In exercise of the powers conferred upon him by section 8(2) of the Immigration Act 1971[1], the Secretary of State hereby makes the following Order:

     1. This Order may be cited as the Immigration (Exemption from Control) (Amendment) (No. 2) Order 1997 and shall come into force on the date, to be notified in the London, Edinburgh and Belfast Gazettes, on which the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Ireland establishing the Independent International Commission on Decommissioning[2] enters into force.

     2. In this Order "the Principal Order" means the Immigration (Exemption from Control) Order 1972[3].

     3. In Article 4 of the principal Order (which exempts certain persons from any provision of the Immigration Act 1971 relating to those who are not British Citizens except any provision relating to deportation), for paragraph (m) there shall be substituted the following paragraphs:

      " (m)

        (i) Any member or servant of the Independent International Commission on Decommissioning ("the Commission") established under an Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Ireland concluded on 26th August 1997,

        (ii) in sub-paragraph (i) above, "servant" includes any agent of or person carrying out work for or giving advice to the Commission,

      (n) any member of the family of a person exempted under any of the preceding paragraphs forming part of his household."

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends Article 4 of the Immigration (Exemption from Control) Order 1972. The effect is to exempt members and servants of the International Commission on Decommissioning from any provision of the Immigration Act 1971 relating to those who are not British Citizens (except any provision relating to deportation).
