In exercise of the powers conferred on the Secretary of State by sections 34, 35 and 54(3) of the Education Act 1997[1], the Secretary of State for Education and Employment and the Secretary of State for Wales hereby make the following Order: Citation, commencement and interpretation 1. - (1) This Order may be cited as the Education (Qualifications and Curriculum Authority and Qualifications, Curriculum and Assessment Authority for Wales) (Transfer of Property and Designation of Staff) Order 1997 and shall come into force on 1st October 1997. (2) In this Order -
(b) any holding of shares in or membership of any company; (c) any act or omission of NCVQ or SCAA before the effective date; (d) any proceedings commenced by or against NCVQ or SCAA before the effective date;
Transfers of land 1. The land in question is the leasehold interest of NCVQ in the premises known as Unit 1, Links Court, Links Business Park, St. Mellons, Cardiff. 2. The records in question are all records relating exclusively to the administration or business of NCVQ, or of any subsidiary of NCVQ or any body or person engaged (by whatever means) at any time in carrying out business of any description for or on behalf of NCVQ, in Wales. 3. The property in question is:
(b) the following property, which is to say, -
(ii) the Compaq computer and monitor bearing the serial numbers 8702HVU76823 and 28436126 respectively and located at the time of making of this Order at the St. Albans premises of NCVQ; (iii) the Compaq computer and monitor bearing the serial numbers 8702HVU70273 and 28467126 respectively and located at the time of making of this Order at the Bristol premises of NCVQ; (iv) the Compaq computer and monitor beating the serial numbers 8702HVU76912 and 26914126 respectively and located at the time of making of this Order at the Leeds premises of NCVQ; and (v) the Compaq computer and monitor bearing the serial numbers 8702HVU76624 and 27350126 respectively and located at the time of making of this Order at the Warrington premises of NCVQ;
(c) all such other property of NCVQ, other than land or intellectual property or records, wherever located, as may appear in an inventory submitted by NCVQ to the Secretary of State before the effective date and may before that date be certified as, in his opinion, needing to be transferred to ACCAC to enable ACCAC to carry out their functions properly.
4. The rights and liabilities in question are all rights and liabilities (other than rights and liabilities in respect of land) arising in relation to -
(b) any holding of shares in or membership of any company by NCVQ; (c) any act or omission of NCVQ before the effective date; (d) any proceedings commenced by or against NCVQ before the effective date;
wholly relating to the administration or business of NCVQ in Wales. Davies, K. M. Ebrahim, K. K. F. Elliott, S. E. Jones, C. D. Marshall, S. E. Morgan, M. Oliver, P. K. Roberts, P. Spinks, A. E. (This note is not part of the Order) This Order transfers property, rights and liabilities (other than rights and liabilities arising under contracts of employment) from the National Council for Vocational Qualifications and the School Curriculum and Assessment Authority to the Qualifications and Curriculum Authority and the Awdurdod Cymwysterau, Cwricwlwm ac Asesu Cymru (otherwise known as the Qualifications, Curriculum and Assessment Authority for Wales). The Order also designates persons employed by the National Council for Vocational Qualifications or the School Curriculum and Assessment Authority for transfer to the Qualifications and Curriculum Authority or the Awdurdod Cymwysterau, Cwricwlwm ac Asesu Cymru.
