CUSTOMS AND EXCISE

The Criminal Law (Consolidation) (Scotland) Act 1995 (Detention by Customs Officers) (Specification of Titles) Order 1997

  Made 26th August 1997 
  Laid before Parliament 27th August 1997 
  Coming into force 1st October 1997 

The Treasury, in exercise of the powers conferred on them by section 26(11) of the Criminal Law (Consolidation) (Scotland) Act 1995[1], hereby make the following Order:

     1. This Order may be cited as the Criminal Law (Consolidation) (Scotland) Act 1995 (Detention by Customs Officers) (Specification of Titles) Order 1997 and shall come into force on 1st October 1997.

    
2. The following titles are specified for the purposes of the definition of "superior officer" in section 26(11) of the Criminal Law (Consolidation) (Scotland) Act 1995 - 

    (a) Anti-Smuggling Manager;

    (b) Cargo Operational Manager;

    (c) Investigation Team Leader;

    (d) Passenger Services Division Operations Manager; and

any other title within job band 9.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order specifies the job titles of those Customs Officers who are "superior officers" for the purposes of the authorisation of detention of persons in connection with certain drug smuggling offences under section 26 of the Criminal Law (Consolidation) (Scotland) Act 1995.
