The Secretary of State, in exercise of the powers conferred on him by section 125(3) and (4) of the Environment Act 1995[1], hereby makes the following Order: Citation 1. This Order may be cited as the Environment Act 1995 (Commencement No. 9 and Transitional Provisions) Order 1997. Provisions coming into force on 1st July 1997 2. The following provisions of the Environment Act 1995 shall come into force on 1st July 1997 -
(b) section 116 in so far as it relates to paragraph 2(4) of Schedule 21 except for the purposes of the application of the substituted section 222 of the Water Resources Act 1991[2] to Part II of that Act.
Transitional provisions
(b) the application relates to discharges which are substantially the same as discharges lawfully made by the Crown before that date without a consent,
the Environment Agency shall be deemed to have given unconditionally the consent applied for and the deemed consent shall continue in force until the application is finally disposed of.
(b) if the Agency gives its consent subject to conditions or refuses its consent, on the expiration of the time limit for appealing against that decision; or (c) if an appeal is duly made against the Agency's decision, on the date on which that appeal is determined or withdrawn.
(This note is not part of the Order) Article 2 brings into force on 1st July 1997 -
(b) section 116 of the Environment Act 1995 in so far as it relates to paragraph 2(4) of Schedule 21 (Crown application of the Water Resources Act 1991) except in relation to Part II of the Water Resources Act 1991 (water resources management).
Article 3 makes transitional provisions in cases where an application for a discharge consent has been made by the Crown before 1st July 1997. (This note is not part of the Order) The following provisions of the Environment Act 1995 have been brought into force by commencement orders made before the date of this Order.
