In exercise of the powers conferred on the Secretary of State by sections 517(6) and 583(3) and (5)(b) of the Education Act 1996[1], the Secretary of State for Education and Employment hereby makes the following Order: 1. - (1) This Order may be cited as the Education Act 1996 (Commencement No. 2 and Appointed Day) Order 1997. (2) In this Order "the Act" means the Education Act 1996. 2. - (1) Section 528 of the Act in its application to England shall come into force on 1st August 1997. (2) The following provisions of the Act shall come into force on 1st September 1997 -

1st September 1997 is hereby appointed for the purposes of section 517(6) of the Act and that day is appointed for all the provisions referred to in that subsection and for all purposes. (This note is not part of the Order) This Order brings into force -
(b) Sections 8 and 348 of the Education Act 1996 (which relate respectively to compulsory school age and to the provision of special education at schools which are not maintained schools) together with associated consequential amendments and repeals on 1st September 1997.
Section 517(6) of the Education Act 1996 provides that as from a day appointed by the Secretary of State section 517 (which relates to payment of fees at schools not maintained by a local education authority) has effect with certain modifications. This Order appoints 1st September 1997 for the purpose of section 517(6). (This note is not part of the Order) Almost all the provisions of the Education Act 1996 came into force on 1st November 1996; a small number of provisions however come into force on a day appointed by Order and the following provision has been brought into force by commencement order made before the date of this Order.
