SOCIAL SECURITY

The Social Security Administration (Fraud) Act 1997 (Commencement No. 1) Order 1997

  Made 24th June 1997 

The Secretary of State for Social Security, in exercise of the powers conferred on her by section 25(1) and (2) of the Social Security Administration (Fraud) Act 1997[1] and of all other powers enabling her in that behalf, hereby makes the following Order:

Citation and interpretation
     1.  - (1) This Order may be cited as the Social Security Administration (Fraud) Act 1997 (Commencement No. 1) Order 1997.

    (2) In this Order, references to "the Act" are references to the Social Security Administration (Fraud) Act 1997 and, except where the context otherwise requires, references to sections and Schedules are references to sections of, and Schedules to, the Act.

2. The day appointed for the coming into force of the provisions of the Act specified in the Schedule to this Order is 1st July 1997.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order provides for the coming into force of provisions of the Social Security Administration (Fraud) Act 1997 on 1st July 1997 for the provisions in - 

     - sections 1 to 4 which relate to the supply and use of information except the coming into force of subsections (3) and (4) of section 122E of the Social Security Administration Act 1992;

     - sections 5 to 10 which relate to the administration of housing benefit and council tax benefit;

     - section 12 which relates to the appointment of inspectors by authorities;

     - sections 13 and 14 which relate to offences;

     - section 17 which relates to reviews in connection with attendance allowance, disability living allowance and disability working allowance;

     - section 18 which relates to medical examinations in connection with attendance allowance and disability working allowance;

     - Schedule 1 (minor and consequential amendments) except for the amendments in paragraph 8;

     - Schedule 2 (repeals) except for the repeal of section 128A of the Social Security Administration Act 1992.
