ROAD TRAFFIC

The Road Vehicles (Construction and Use) (Amendment) (No. 4) Regulations 1997

The Secretary of State for Transport, in exercise of the powers conferred by section 41(1), (2) and (5) of the Road Traffic Act 1988[1] and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

     1. These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 4) Regulations 1997 and shall come into force on 30th June 1997.

    
2.  - (1) The Road Vehicles (Construction and Use) (Amendment) (No. 6) Regulations 1996[2] shall be amended as follows.

    (2) In regulation 4, in both paragraphs (2) and (3), for the words ""and is first used before 1st July 1997"" to be inserted into paragraphs (10) and (10B)(c) of regulation 61 (emissions) of the Road Vehicles (Construction and Use) Regulations 1986[3], there shall be substituted the words ""and is first used before 1st January 1998"".

EXPLANATORY NOTE

(This note is not part of the Regulations)


The Motor Vehicles (Approval) (Amendment) Regulations 1997 (S.I. 1997/1366) amend the Motor Vehicles (Approval) Regulations 1996 (S.I. 1996/3013) ("the Approval Regulations") so as to postpone the date appointed by those Regulations for the purposes of section 63(1) of the Road Traffic Act 1988 from 1st July 1997 to 1st January 1998.

As a consequence of this, these Regulations amend the Road Vehicles (Construction and Use) (Amendment) (No. 6) Regulations 1996 ("the 1996 Regulations"), which in turn amend the Road Vehicles (Construction and Use) Regulations 1986 ("the 1986 Regulations").

By virtue of regulation 2, paragraphs (10) and (10B)(c) of regulation 61 (emissions) of the 1986 Regulations will continue to apply in relation to amateur-built vehicles first used before 1st January 1998, subject to modifications (contained in a new Schedule 2A inserted in the 1986 Regulations by the 1996 Regulations) in relation to vehicles for which a Minister's approval certificate has been issued by virtue of the Approval Regulations.
